The Claim:

A class action lawsuit is very different from a criminal proceeding. In order for a class action to take place, it is traditionally started with a party filing a complaint. Two things are generally present with a class action; firstly, there is a complaint, or a claim. Secondly, there is usually a form of negligence present within the claim. In the case with Benicar, the claim states that the blood pressure medication’s manufacturer, Daiichi Sankyo, Inc. neglected to warn physicians and entities, as well as patients, of the potential for Sprue-Like Enteropathy, and Gastrointestinal illnesses that are very similar to those symptoms of Celiac Disease (Thomson Reuters, 2017). The patients that have received this prescription have experienced severe cases of chronic diarrhea, significant weight loss, nausea and overall malnutrition.

What is Benicar and What is it Used For?

Benicar, also known as the drug olmesartan medoxomil or Benicar HCT, which is the drug olmesartan medoxomil-hydrochlorothiazide, is used to treat high blood pressure. The drugs Azor and Tribenzor are also in the same family of drugs with a combination of olmesartan medoxomil, and amlodipine in them (“Benicar,” n.d.)


Used primarily for hypertension, Benicar is designed to block specific receptors better known as, angiotensin receptors. What is Angiotensin? Angiotensin is a protein hormone that originates production in the liver, and then is released where the kidney finishes off the production, creating the end result. As it travels through your system, it attaches to receptors found present in most tissues of the body ("You and Your Hormones,” 2016).

What are the Effects it has on the Body?

Angiotensin receptors help control the fluid in your body for more balance. Angiotensin hormones assist in maintaining blood pressure, and makes your blood vessels narrower. This protein hormone ultimately has multiple effects throughout the body, more generalized, is that of: Vascular Effects, Neurological Effects, and Kidney Effects. Too much production of this hormone, and too little of this hormone can both have adverse effects on a person’s body, and daily health. Benicar blocks these angiotensin receptors thus resulting in the dilation of a person’s blood vessels.

Benicar Injuries & Side Effects

Dr. Josephy Murray, highly recognized in the field of Gastroenterology and Hepatology, conducted recent studies involving sprue-like enteropathy linking it to the use of Benicar. Patients of the study were originally diagnosed as having Celiac Disease. Olmesartan and Drug-Induced Enteropathy resemble the symptoms of Celiac Disease encompassing, severe weight loss, chronic diarrhea, and villous atrophy, all doing permanent damage to a person’s intestines. The patients of the study did not respond to gluten free diets, which is a common form of treatment for those diagnosed with Celiac Disease (Tran & Hanlin, 2014).

Once patients discontinued the use of Benicar, their symptoms dissipated and they experienced weight gain, back to their normal weight. The Mayo Clinic recently published Dr. Murray’s findings, and the study concluding the link between the use of the drug and the gastrointestinal illnesses.

Among the vast list of side effects, here are the most common and severe:


  • Chronic Diarrhea
  • Dramatic Weight Loss
  • Malabsorption
  • Gastrointestinal Disorders
  • Hypotension
  • Death to Unborn Child
  • Kidney Problems
  • Nausea
  • Uric Acid in Blood
  • Respiratory Tract Infections
  • Vision Loss (“Benicar,” n.d.)


Some side effects are noticed almost immediately after the start of taking Benicar. If you or someone you know has been experiencing any or some of these symptoms, and is currently or has taken the prescribed medication, please contact a healthcare provider immediately. (“Benicar,” n.d.) Doctors state that if they had known about the high potential of risk for these side effects, they would have prescribed something different. At the very least, doctors state that if they had known of the risks, they could have been observing patients for the above-mentioned symptoms.
